Australia is the only country in the world to detain children seeking asylum as a first option. Under the Migration Act 1958 (Cth), non-citizen children who arrive without a visa must be detained, and are only released at the discretion of the Minister for Immigration and Border Protection. The policy and practice of detaining children has been adopted by successive Australian governments from both sides of politics for over 20 years.
